These are our Booking Conditions:
Booking and Payment
Your Booking is with New Horizon Sailing.
Your payments are deposited into a client account and released on completion of your holiday.
Provisional bookings accepted by telephone or E-mail will be held for seven days. A completed and signed booking form together with a deposit of 25% of the total cost is required to secure a booking.
We will send you a receipt showing the balance which is due 60 days before departure.
All prices quoted to you include VAT (if applicable).
Cancellation
If you cancel we will refund all but half of the deposit provided that we are able to re-sell your place(s). If we are unable to re-sell your place, no refund will be made.
If through unforeseen circumstances we have to cancel your cruise we will offer you an alternative date(s) and if this is not acceptable to you, everything already paid to us will be refunded and we have no further liability. If cancellation is forced on either party by regulations imposed by the UK or Scottish Governments, for example, the imposition of travel restrictions, quarantine or social distancing requirements related to the Covid 19 pandemic, the cost will be shared equally by both parties i.e. 50% of any sums paid or due will be refunded.
Insurance
The yacht insurance does not cover you for accidents, illness, loss or damage to personal effects unless caused by our negligence.
Should you contract an infectious disease during or after your holiday or training course, no liability will be attached to the skipper, crew or other guests.
It is your responsibility to ensure that you have insurance appropriate for the area of the cruise to cover medical, personal accident, holiday cancellation and loss or damage to personal effects.
Variations
The description of the Yacht and equipment is intended to be accurate but we are not liable for any minor inaccuracies.
The decision of the skipper is final in all matters related to the operation of the yacht and her itinerary and we will not be liable if, for example, it is necessary to delay departure or arrival, or vary the cruising area for any reason including weather, fitness of the crew, malfunction of the yacht systems etc.
The skipper may add a second crew at his discretion.
Guests are expected to accurately report any fitness or health issues at the time of booking or which have arisen prior to embarkation. This may include specific vaccination or testing requirements, related to the Covid 19 pandemic, which will be communicated by the Company with reasonable notice. Non-compliance with those requirements will be reason to refuse boarding.
Equality & Diversity
Our policy is to accept applications from any person aged 18 years or over. However, applicants should be fit enough to participate in activities around the yacht, including being able to board the yacht via ladder from the tender, enter a life raft in emergency and move safely around the different levels of the yacht. If in doubt, please discuss with us before booking.
Children
Children under eighteen are welcome if they are with a parent or adult carer. Children under sixteen are not accepted except on wholeboat charters with their family.
Data Protection
We will hold on file the minimum necessary data relating to customers and undertake to keep it confidential and not pass it on to any third parties.
Dispute
If we are unable to resolve a dispute to your satisfaction, we will seek help from an independent arbitration service or from the RYA in the case of RYA training courses. English law applies.
